8:30 a.m.
The Carlton County Board of Commissioners met this 12th day of May, 2009, in Regular Session in the Boardroom of the Courthouse.

Chairperson Brenner called the meeting to order at 8:30 a.m. Members present: Aanerud, Bodie, Brenner, Pihlman and Proulx.Ê Absent: None

The meeting opened with The Pledge of Allegiance to the Flag.

 Motion by Pihlman, seconded by Bodie, and carried by all yea votes to approve the Agenda as amended.

Motion by Aanerud, seconded by Bodie, and carried by all yea votes to approve the Minutes of the April 27, 2009, Adjourned Board Meeting.

Tom Collins, Archie Chelseth, and Rob Schilling, representatives from Sappi Fine Paper, were present to provide information on the proposed construction of a new paper machine at the Cloquet Plant.

Scott Dane, Associated Contract Loggers and Truckers of Minnesota, was present to request consideration of the Board to change/alter the policy concerning the granting of contract extensions for Timber Contracts, due to financial hardships in the timber industry.

 Motion by Pihlman, seconded by Bodie, and carried by all yea votes to authorize and instruct the Land Commissioner to review the current county policy (and the policies of other counties) with regards to the granting of timber contract extensions, and to further make a recommendation for change – if any – to the county board.

 At 9:25 a.m. a public hearing was held to discuss the issuance of an “Off Sale” Liquor License for Big Lake Golf. No persons were present to comment for or against the proposed issuance of the license, nor was any correspondence received by staff. The public hearing was adjourned to the Regular Meeting at 9:30 a.m.

 Motion by Pihlman, seconded by Bodie, and carried by all yea votes to approve the destruction of 319 closed Income Maintenance files. These files have been closed the appropriate amount of time prior to their destruction.

 Motion by Pihlman, seconded by Proulx, and carried by all yea votes to adopt the following resolution:Ê (09-049)

WHEREAS, Carlton County currently has a contract with the Minnesota Department of Human Services to administer the MinnesotaCare Health Care Program; and

WHEREAS, Carlton County is paid $30 for each MinnesotaCare application processed, with a maximum amount of the contract set at $35,839; and

WHEREAS, Carlton County is processing more applications than were projected by the State.

NOW, THEREFORE, BE IT RESOLVED that the Carlton County Board of Commissioners does hereby approve an amendment to the said contract with the Minnesota Department of Humans Services to reset the maximum amount of said contract at $40,839 for the processing of MinnesotaCare Health Care applications.

Motion by Aanerud, seconded by Bodie, and carried by all yea votes to accept the recommendation of the Carlton County Planning Commission and approve the following Conditional Use Permit with conditions as on file in the Zoning Office:

No. 409006, Jeffrey and Ellie Grover, to change the use of an existing structure to a single family dwelling in a C-2, Highway Commercial District on property described as the Part of the Southwest Quarter of the Northeast Quarter (SW 1/4 of NE 1/4) of Section Twenty-five (25), Township Forty-eight (48), Range Eighteen (18) in Atkinson Township.

 Motion by Aanerud, seconded by Pihlman, and carried by all yea votes to adopt the following resolution: (09-050)

WHEREAS, the Carlton County Board of Commissioners, acting through its Planning Commission, did conduct a public hearing to consider amendments to its Carlton County Primary Structure Ordinance (Ordinance No. 22A); and

WHEREAS, following the public hearing the Carlton County Planning Commission did recommend changes to said Ordinance No. 22A to reflect current practices.

NOW, THEREFORE, BE IT RESOLVED that the Carlton County Board of Commissioners does hereby accept the recommendations of the Carlton County Planning Commission and approve the changes to the Carlton County Primary Structure Ordinance (Ordinance No. 22A), relating to Primary Structures.

 Motion by Aanerud, seconded by Pihlman, and carried by all yea votes to adopt the following resolution: (09-051)

WHEREAS, the Carlton County Board of Commissioners did amend their County Ordinance #17 (Carlton County Solid Waste Ordinance) to allow for consideration of the long term storage of tire chips (greater than 90 days); and

WHEREAS, the Carlton County Board of Commissioners has received a request from the Carlton County Transportation Department for the consideration and approval to store tire chips at the Thompson Pit.

NOW, THEREFORE BE IT RESOLVED that the Carlton County Board of Commissioners does hereby approve the request of the Carlton County Transportation Department and will allow for the long term storage (more than 90 days) of tire chips at the Thompson Pit behind the County Shop in Barnum Township on property described as Part of the Northwest Quarter of the Northeast Quarter (NW 1/4 of NE 1/4), Section eleven (11), Township Forty-six (46), Range Nineteen (19).

Motion by Bodie, seconded by Aanerud, and carried by all yea votes to reapprove setting a Timber Auction for June 10, 2009, at 10:00 a.m. at the Minnesota Department of Natural Resources Offices, 1604 Highway 33 South, Cloquet. This Timber Auction is being reset because of a change in location for the auction.

Motion by Pihlman, seconded by Aanerud, and carried by all yea votes to adopt the following resolution: (09-052)

WHEREAS, bids have been received by the County Auditor/Treasurer for bituminous milling, surfacing, aggregate shouldering and striping on CSAH 4, CSAH 22, CR 104, CR 120 and CR 139; and

WHEREAS, said bids or proposals were duly opened in the CarltonÊ County Engineer’s Office at 10:00 a.m., Monday, May 11, 2009 and this Board has, with the County Highway Engineer, determined the lowest bidder of said project for which proposals were invited and submitted; and

WHEREAS, in the judgment of this Board, it is for the best interest of Carlton County that the award of said contract be made to the lowest bidder.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Carlton County, Minnesota, in regular session duly convened, that they hereby approve the award of the contract on the above project to the lowest bidder:
 Ulland Brothers $1,698,675.03

BE IT FURTHER RESOLVED that the Chairperson of the County Board, the County Auditor/Treasurer, and the County Attorney, on behalf of the County of Carlton, are hereby authorized to approve the Contractor’s Performance Bonds and to execute the bonds and contracts with the Contractor for the above listed project.

 Motion by Aanerud, seconded by Bodie, and carried by all yea votes to adopt the following resolution: (09-053)

WHEREAS, the Carlton County Board of Commissioners did previously take action for the design of a Recreational Trail from the junction of the Munger Trail in the City of Carlton to and through the City of Cloquet; and

WHEREAS, said design plans have been approve by the State of Minnesota.

NOW, THEREFORE, BE IT RESOLVED that the Carlton County Board of Commissioners does hereby authorize and approve the County Engineer to seek bids for the construction of said trail from the junction of the Munger Trail in the City of Carlton to the Park and Ride location (near Interstate Highway 35) in the City of Scanlon.

 Motion by Pihlman, seconded by Proulx, and carried by all yea votes to adopt the following resolution: (09-054)

WHEREAS, it has become desirous to enter into a Joint Powers Agreement with the State of Minnesota, acting through its Minnesota Department of Corrections (Moose Lake Correctional Facility). Whereby in the event of a disaster or emergency, Carlton County and the State of Minnesota will provide mutual aid beyond their respective jurisdictions.

NOW, TEHREFORE, BE IT RESOLVED that the Carlton County Board of Commissioners does hereby authorize and approve entering into a Joint Powers Agreement with the State of Minnesota for mutual aid services.

Motion by Pihlman, seconded by Bodie, and carried by all yea votes to adopt the following resolution: (09-055)

BE IT RESOLVED to accept the recommendation of the Carlton County Economic Development Advisory Committee and approve the following loan out of Occupational Tax Monies allocated to Carlton County through the Financial Assistance Program:

 Cloquet Development Group, LLCE - $47,452

 Motion by Aanerud, seconded by Pihlman, and carried by all yea votes to authorize and approve the County Auditor/Treasurer to establish a saving account at Wells Fargo Bank.

 Motion by Aanerud, seconded by Proulx, and carried by all yea votes to approve an on and off sale liquor license as follows:

 Motion by Pihlman, seconded by Bodie, and carried by all yea votes to adopt the following resolution: (09-056)

BE IT RESOLVED to approve Applications for Grant-in-Aid for Snowmobile Trail Assistance for the Wood City Riders, Carlton County, Moose Horn Rod and Gun Club, Kettle River Snowmobile Club, Cromwell Snowmobile Club, and the Wrenshall Snowsharks Snowmobile Club for 2009-2010, contingent upon the County Trail Coordinator working with the County Land Commissioner in updating trail permits. All County costs will be for in-kind services.

BE IT FURTHER RESOLVED to authorize the Carlton County Auditor/Treasurer to serve as the fiscal agent for said Snowmobile Trail Grant in Aid monies.

Motion by Pihlman, seconded by Aanerud, and carried by all yea vote to approve the appointment of Commissioner Proulx as an alternate to the Carlton County Facilities Study Committee.

 Motion by Pihlman, seconded by Proulx, and carried by all yea votes, that this meeting be adjourned.
